La d\u00e9finition pr\u00e9cise de cette notion, n\u00e9anmoins, fait toujours l&rsquo;objet de vifs d\u00e9bats, au sein des tribunaux, au travail, sur les r\u00e9seaux sociaux, et jusque dans l&rsquo;intimit\u00e9 d&rsquo;une \u00ab chambre \u00e0 soi \u00bb.<br \/>\nLes contours l\u00e9gaux et judiciaires du concept de \u00ab vie priv\u00e9e \u00bb demeurent, aujourd\u2019hui encore, relativement flous. Au Royaume-Uni, la loi de 1998 sur les droits de l&rsquo;homme dispose par exemple que \u00ab toute personne a droit au respect de sa vie priv\u00e9e et familiale, de son domicile et de sa correspondance \u00bb. Elle pr\u00e9cise que la \u00ab vie priv\u00e9e \u00bb peut \u00eatre d\u00e9finie comme le droit de vivre sa vie en priv\u00e9, sans ing\u00e9rence du gouvernement, \u00e0 moins que celle-ci ne constitue une menace pour la loi, la s\u00e9curit\u00e9 nationale et \u00ab la sant\u00e9 ou la morale \u00bb \u2013 des exceptions assez nombreuses et impr\u00e9cises pour rendre poreuse la fronti\u00e8re entre les sph\u00e8res priv\u00e9es et publiques.<br \/>\nAux \u00c9tats-Unis, et ce bien que la vie priv\u00e9e ne soit pas explicitement mentionn\u00e9e dans la Constitution, celle-ci b\u00e9n\u00e9ficie normalement de la protection de la loi. Th\u00e9oriquement \u00e9tablie par le quatorzi\u00e8me amendement et provisoirement d\u00e9finie en 1888 par Thomas M. Cooley, juriste am\u00e9ricain et juge \u00e0 la Cour supr\u00eame du Michigan, comme \u00ab le droit \u00e0 la tranquillit\u00e9 \u00bb (the right to be let alone), elle n&rsquo;a cependant gu\u00e8re \u00e9t\u00e9 \u00e9voqu\u00e9e jusqu&rsquo;\u00e0 l&rsquo;arr\u00eat Griswold v. Connecticut (1965). \u00c0 travers cette affaire, la Cour supr\u00eame f\u00e9d\u00e9rale a reconnu le droit d\u2019acc\u00e8s des couples mari\u00e9s \u00e0 la contraception, affirmant un \u00ab droit \u00e0 la vie priv\u00e9e conjugale \u00bb et \u00e9tablissant ainsi la base juridique du droit \u00e0 la vie priv\u00e9e dans l&rsquo;ensemble du pays. R\u00e9cemment, cependant, l&rsquo;existence de ce droit a \u00e9t\u00e9 remise en question par cette m\u00eame Cour via le jugement rendu dans l&rsquo;affaire Dobbs v. Jackson Women&rsquo;s Health (2022). Celui-ci postule que pour certaines \u00ab questions de nature morale \u00bb, le gouvernement am\u00e9ricain n\u2019est pas tenu de respecter la vie priv\u00e9e des citoyens. Cet exemple illustre qu\u2019au XXIe si\u00e8cle, l\u2019id\u00e9e d\u2019une \u00ab sph\u00e8re priv\u00e9e \u00bb libre de toute ing\u00e9rence gouvernementale demeure mal d\u00e9finie. Il est certain, par ailleurs, que la protection, la collecte et l&rsquo;utilisation des donn\u00e9es par des entit\u00e9s gouvernementales et non gouvernementales contribueront \u00e0 red\u00e9finir le sens m\u00eame du droit \u00e0 la vie priv\u00e9e.<br \/>\nCette conf\u00e9rence aura ainsi pour but d\u2019explorer les fronti\u00e8res mouvantes entre les sph\u00e8res priv\u00e9e et publique, d&rsquo;un point de vue \u00e9thique, juridique, politique, \u00e9conomique et social, et d\u2019inviter \u00e0 interroger la d\u00e9finition juridique du droit \u00e0 la vie priv\u00e9e dans les soci\u00e9t\u00e9s anglophones, notamment au prisme de l&rsquo;identit\u00e9 des personnes dont la vie priv\u00e9e peut \u00eatre \u00ab l\u00e9gitimement \u00bb envahie et\/ou examin\u00e9e. Elle s\u2019attachera \u00e9galement \u00e0 \u00e9tudier et questionner la mise en sc\u00e8ne de la vie priv\u00e9e, et la fa\u00e7on dont celle-ci peut \u00eatre utilis\u00e9e comme un levier politique ou \u00e9conomique \u2013 un outil militant servant \u00e0 d\u00e9stigmatiser un comportement et obtenir des droits ou pour lancer une campagne politique, par exemple. La vie priv\u00e9e peut \u00e9galement \u00eatre marchandis\u00e9e et commercialis\u00e9e via les r\u00e9seaux sociaux, qui r\u00e9mun\u00e8rent les cr\u00e9ateurs de contenu pour qu&rsquo;ils l\u00e8vent le voile sur leur intimit\u00e9.<br \/>\nEnfin, le personnel a-t-il vocation \u00e0 \u00eatre politique ?<br \/>\nParmi les pistes de r\u00e9flexion possibles, nous prendrons notamment en consid\u00e9ration les communications qui s&rsquo;inscrivent dans les th\u00e8mes suivants :<br \/>\n\u27a2 \u00c9tat, institutions, justice et intimit\u00e9 : comment la vie priv\u00e9e est-elle r\u00e9gul\u00e9e ? De qui r\u00e9gule-t-on la vie priv\u00e9e ? Qui r\u00e9gule la vie priv\u00e9e ? Censure ; d\u00e9bats juridiques et l\u00e9gaux sur la d\u00e9finition de la vie priv\u00e9e ; quand les instances publiques passent \u00e0 la loupe l\u2019intimit\u00e9 des individus (adoption, enqu\u00eates sociales\u2026) ; d\u00e9lation et lanceurs\/ses d\u2019alerte.<br \/>\n\u27a2 Intimit\u00e9 et surveillance : intimit\u00e9 dans les prisons ; \u00e9tat policier et surveillance \u00e9tatique ; confidentialit\u00e9 et protection des donn\u00e9es<br \/>\n\u27a2 Intimit\u00e9 et militance : la lutte pour le droit \u00e0 la vie priv\u00e9e ; d\u00e9voiler sa vie priv\u00e9e comme acte militant et\/ou \u00e0 des fins de sensibilisation ; \u00e9crits de l\u2019intime \u00e0 vis\u00e9e militante et \u00e9godocuments, etc.<br \/>\n\u27a2 Mettre en sc\u00e8ne l\u2019intimit\u00e9 : mise en sc\u00e8ne de la vie priv\u00e9e (r\u00e9seaux sociaux, t\u00e9l\u00e9-r\u00e9alit\u00e9 et m\u00e9dias) ; la vie priv\u00e9e et politiques; biopic, etc.<br \/>\n\u27a2 \u00c9conomie de l\u2019intimit\u00e9 : marchandiser la vie priv\u00e9e. Les blogs et les cha\u00eenes familiales sur internet, les r\u00e9seaux sociaux et Youtube (aspect \u00e9conomique et financier, type de public, dimension \u00e9thique, relation aux normes) ; la protection de la vie priv\u00e9e comme activit\u00e9 \u00e9conomique, etc.<br \/>\n\u27a2 Intimit\u00e9 et pouvoir m\u00e9dical : rapport entre le m\u00e9decin et le corps ; entre l\u2019autorit\u00e9 m\u00e9dicale et l\u2019individu ; consentement et refus de soins etc\u2026<\/p>\n<p>Toutes les approches du sujet sont les bienvenues : historique, juridique, sociologique, politique, \u00e9conomique ou culturelle (litt\u00e9raire, artistique, cin\u00e9matographique). Nous \u00e9tudierons avec attention les propositions de jeunes chercheurs\/ses et de chercheurs\/ses confirm\u00e9.e.s.<\/p>\n<p>Call for papers:<\/p>\n<p>\u201cIf the right to privacy means anything, it is the right of the individual, married or single, to be free from unwanted government intrusion.\u201d Justice William Brennan \u201cArguing that you don&rsquo;t care about the right to privacy because you have nothing to hide is no different than saying you don&rsquo;t care about free speech because you have nothing to say.\u201d Edward Snowden<\/p>\n<p>In 1953, the European Convention on Human Rights recognized privacy as a human right. Yet, what the notion actually entails is still hotly debated in courtrooms, in the workplace, on social media, and even in the intimacy of a room of one\u2019s own.<br \/>\nCourts themselves have long interpreted the concept of \u2018private life\u2019 very broadly. In the UK, the 1998 Human rights Act states that \u201cEveryone has the right to respect for his private and family life, his home and his correspondence.\u201d It puts forth that privacy is the right to live your life privately, without government or legal interference, lest that it might pose a threat to the law, national security, and \u201chealth or morals.\u201d Those exceptions are rather broad which makes the boundary between the private and the public rather blurry.<br \/>\nIn the United States, although the right to privacy is not one of the rights enumerated in the Constitution, it does not mean that it is not entitled to protection under the law. While theoretically established by the Fourteenth Amendment, and tentatively defined in 1888 by American lawyer and Michigan Supreme Court Justice Thomas M. Cooley as \u201cthe right to be let alone,\u201d little was said on the matter until Griswold v. Connecticut (1965). In this case, the federal Supreme Court affirmed the right of married persons to obtain contraceptives, asserting a \u201cright to marital privacy\u201d and establishing the legal basis for the right to privacy with respect to intimate practices in general throughout the country. Recently, however, the existence of this right has been questioned by that same Court in Dobbs v. Jackson Women\u2019s Health (2022), which posits that for certain \u201cmoral questions\u201d the government has the right to intervene without being bound to respect people\u2019s privacy. \u201cMoral question\u201d being a rather vague phrase the \u201cprivate sphere\u201d that is free from government intervention remains ill-defined. The same holds true for online privacy which constitutes a new frontier that is still being drawn and fought over \u2013 data protection, collection and use by governmental and non-governmental entities will undoubtedly contribute to the very meaning of the right to privacy.<br \/>\nIn this conference, we would like to explore the unstable boundaries between the private and the public spheres, from ethical, legal, political, economic and social standpoints. This invites us to ponder over how the legal definition of the right to privacy is delineated in English-speaking societies, and over the identities of the people whose privacy can \u201clegitimately\u201d be invaded and\/or scrutinized. On the other hand, staging one\u2019s privacy can be used as a way to gain political or economic power: it can be part of the activist toolbox to destigmatize a conduct in order to gain rights or as a commodity to establish a political campaign. It can also be a business and as such become commodified through social media companies who pay content creators to reveal their private lives to their audiences. The way intimacy is staged on such a public platform is worthy of inquiry as well as the impact of such staging on the audience.<br \/>\nUltimately, is the personal always bound to be political? Among the possible avenues of inquiry, we will consider papers that fall under the<br \/>\nfollowing themes:<br \/>\n\u27a2 State, institutions, justice and intimacy: How is private life regulated? By whom? Whose private life is regulated? Censorship ; judicial and legal debates over the definition of privacy ; public entities scrutinizing people\u2019s private lives (custody and adoption cases, etc.) ; denunciation and whistle-blowing, etc.<br \/>\n\u27a2 Privacy and surveillance: privacy in prison ; police state and surveillance state ; protecting data and online privacy<br \/>\n\u27a2 Intimacy and activism: the fight to protect the right to privacy ; sharing one\u2019s private life to raise awareness and\/or to destigmatize a conduct or an identity ; militant memoirs, and ego-documents, etc.<br \/>\n\u27a2 Staging intimacy: staging one\u2019s private life (social media, reality tv, the media) ; private life and politics ; biopics, etc.<br \/>\n\u27a2 Intimacy as a commodity: family blogs and family channels on the internet, social media and Youtube (economic and financial aspect, audience, ethical dimension and relation to norms) ; business of private life protection, etc.<br \/>\n\u27a2 Intimacy and medical power : doctors and the body ; medical authority and patients ; consent and refusal of care, etc.<br \/>\nProposals of 250 to 500 words in English or in French accompanied by a short biography should be sent to eglantine.zatout, irene.delcourt and marie.moreau before March 25th 2024. All approaches to the subject are welcome: historical, judicial, sociological, political, cultural (literary, artistic, cinematographic\u2026), economic.
